General Terms & Conditions of Sale and Participation - Agenda Pacific Pty Ltd

Article 1: Purpose
1.1 The purpose of the present general terms and conditions of sale and participation (hereinafter the “GTCP”) is to define the terms and conditions of registration and participation in all conferences (hereinafter the “Event”) organised by Agenda Pacific (ABN: 38166482935), a proprietary limited company with its registered office at 5/1A Neptune Street, Sydney, NSW, 2034, represented by Ms. Corinne Estrada in her capacity as CEO, duly authorised for the purposes hereof.
1.2 These GTCP constitute the entire and sole agreement between Agenda Pacific and the Participant (hereinafter the “Parties”); they cancel and replace any previous agreement relating to their subject.
Article 2: Acceptance and modification of the GTCP
2.1 Any registration for the Event by a participant (hereinafter the “Participant”) implies the Participant’s complete acceptance of the version of the present GTCP in force on the day of the Participant’s access to the venue of the Event and obliges him/her to strictly comply with it.
2.2 These GTCP or the latest version are accessible at www.communicatingthearts.com (the “Website”).
2.3 Agenda Pacific reserves the right to modify these GTCP at any time and without recourse from the Participant.
2.4 These modifications are binding on the Participant as soon as they are published online. Therefore, it is the Participant's responsibility to regularly consult the GTCP, which are permanently available on the Website. Any use of the services after the GTCP have been modified shall constitute tacit acceptance by the Participant of the new GTCP.
Article 3: Registration
3.1 By registering, the Participant agrees that Agenda Pacific may collect their personal information to communicate with them by mail or telephone and may share this information with its related companies and promotional partners who may also contact the Participant (for example the payment platform). For details on how Agenda Pacific collects, uses, and discloses personal information, please refer to Agenda Pacific's Privacy Policy.
3.2 By registering for this Event, the Participant grants Agenda Pacific the right to use their role, their company name and its official logo to promote and publicise the Event in any manner and media.
3.3 If the Participant is not officially sponsoring the Event, the Participant must respect fellow Participants and refrain from wearing branded t-shirts or distributing merchandise.
Article 4: Prices and payment
4.1 The person making this booking warrants that they have the authority to do so on behalf of the named business and binds the business to this agreement.
4.2 All transactions are in AUD and include 10% GST.
4.3 Participants may pay for their registration to the Event by credit card via a secure payment system. The Participant is solely responsible for the payment by credit card of their registration to the Event. Agenda Pacific is not responsible for payment problems related to malfunctions of the e-commerce service.
4.4 A payment processing fee may apply to all credit card payments in addition to the transaction fee.
4.5 All prices are fixed. Agenda Pacific may, in its absolute discretion, change the prices at any time. Any changes will not affect registrations that have already been confirmed.
4.6 It is understood that Agenda Pacific reserves the right at any time to:
Refuse any registration or participation in the Event from a Participant who is not up to date with all their payments;
Refuse any registration from a Participant for legitimate and non-discriminatory reasons;
Exclude,, without compensation, at any time any Participant whose behaviour interferes with the safety of the Event and/or is in serious breach of these GTCP;
Exclude, without compensation, any Participant who has made false declarations at the time of registration.
4.7 Should the Participant encounter any difficulties making payment through a credit card, Agenda Pacific can provide the Participant with an invoice by contacting: corinne@communicatingthearts.org. Participants must be aware that once this invoice has been issued, it cannot be subject to cancellation, and the Participant is hereby committed to remitting payment.
Article 5: Modification / Cancellation / Replacement
5.1 In case of cancellation by the Participant or absence on the day of the Event, the registration fee remains fully due and is non-refundable.
5.2 It is expressly agreed between the Parties that the date scheduled for the holding of the Event may be freely postponed as well as the format modified in part or in full in digital form in the event of force majeure. In this case, registrations will be carried over to the new date. If the Participant does not wish to postpone their registration to another event proposed by Agenda Pacific at an equivalent rate, no compensation can be claimed by the Participant.
5.3 Agenda Pacific cannot promise the attendance of any Speaker or other Participant, and the proceedings of all sessions. Agenda Pacific will not refund the Participant’s registration or provide any other compensation based on changes to the program.
5.3. In case of impossibility of participating in the Event, the Participant may transfer their ticket, free of charge, to another individual by changing the Participant's name. This request must be made at least 7 days before the Event date by emailing corinne@communicatingthearts.org.
5.4 If, for any reason, the Event does not go ahead due to circumstances beyond Agenda Pacific’s control (e.g., government restrictions like border closures or changes in permit zones), Agenda Pacific will endeavour to reschedule the event. If the Event is unable to be rescheduled, Agenda Pacific will issue a credit note equal to the value of the ticket purchased.
Article 6: Protection of Personal Data
6.1 The Participant has the right to access and rectify their personal data, request its deletion, object to its processing and obtain its limitation where applicable.
To exercise their rights and/or obtain more information on Agenda Pacific's personal data protection practices, the Participant is invited to consult the privacy policy available on the Website (www.communicatingthearts.com).
Article 7: Image rights
7.1 By registering, the Participant agrees that their image may be captured during the Event by photographs and/or films made by Agenda Pacific.
7.2 By registering, the Participant consents to the use of these images and videos on Agenda Pacific's social media, website, or newsletters during and after the Event.
7.3 By registering, the Participant agrees that their images and videos captured during the Event may be used for commercial purposes to promote future editions of the conferences, such as in Agenda Pacific press releases, newsletters, or social media.
Article 8: Speakers
8.1 By registering as a speaker at the conference, the Speaker agrees that their presentation may be professionally recorded and may be published on the Agenda Pacific YouTube channel and social media.
8.2 Speakers are not allowed to use any content that infringes another party’s intellectual property rights, is harassing, misleading, or unlawful. To ensure a clear and focused event experience, the Speaker agrees not to organise or host any events that may draw Participants away from or cause a conflict with Agenda Pacific.
Article 9: Intellectual property
9.1 Unless Agenda Pacific notifies otherwise, the Participant is permitted to take photos, videos, or audio recordings (collectively, “Recordings”) of the sessions held at the Event, as long as they comply with these terms.
9.2 These Recordings may include content protected by copyrights, trademarks, or other rights. Other than for their personal use, the Participant is not allowed to copy, reproduce, publish, or distribute the recordings without Agenda Pacific's written permission.
9.3 The Participant is allowed and encouraged to disseminate the Event content through social media provided that they credit the Event organised by Agenda Pacific and respect copyrights, trademarks or other rights..
9.4 The opinions expressed by any Speaker, Participant or Sponsor are not necessarily the opinions of Agenda Pacific. All event Speakers, Participants and Sponsors are responsible for their content (including presentations, marketing collateral, advertising, and online web content).
Article 10: Miscellaneous provisions
10.1 If any provision of these GTCP is declared null and void or inapplicable due to a law, regulation, or final court decision, it will be deemed unwritten, and the remaining provisions will continue to be in effect.
10.2 The contractual relations between Agenda Pacific and the Participant are governed solely by the provisions of these GTCP.
Article 11: Applicable law and jurisdiction
11.1 These GTCP are subject to the laws of New South Wales, Australia.
11.2 Any dispute arising from the validity, interpretation, or performance of these GTCP, in the absence of an amicable resolution, shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
